1. Business, Scope and Application

These Terms and Conditions apply to the use of the Almond Store online shop and to contracts entered into through the shop for the purchase of electronic products, hair care products, beauty products and any related services offered by Almond Store.

Almond Store is operated by PA Digital Business LLC, located at 9380 SW 72nd St, Ste B-214, Miami, FL 33173, United States.

These Terms apply primarily to consumers purchasing goods for personal use. Where relevant, certain provisions may also apply to other customers.

Nothing in these Terms excludes, restricts or otherwise affects any mandatory rights available to consumers under applicable UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Contract Language and Formation of the Contract

The language of the contract is English unless otherwise expressly stated on the Almond Store website.

Products displayed on our online shop constitute an invitation to customers to place an order and do not, by themselves, constitute a legally binding offer by Almond Store.

By completing the checkout process and submitting an order, you make an offer to purchase the selected products subject to these Terms.

An automatically generated order acknowledgement confirms only that we have received your order. It does not necessarily mean that your order has been accepted.

A binding contract is formed when Almond Store expressly confirms acceptance of your order or dispatches the goods, whichever occurs first.

We may decline an order before acceptance where reasonably necessary, including where a product is unavailable, payment cannot be authorised, information provided is materially incorrect, a pricing or listing error has occurred, or there are reasonable grounds to suspect fraud or misuse.

If payment has already been taken for an order that we are unable to accept, the relevant amount will be refunded or the payment authorisation released as appropriate.


3. Product Availability and Product Information

We take reasonable care to ensure that product descriptions, photographs, specifications, compatibility information, colours, accessories and performance information displayed on our shop are accurate.

Images are provided for illustrative purposes and the appearance of colours may vary slightly depending on screen settings, lighting and device characteristics.

Minor manufacturing variations or technical updates may occur where they do not materially affect the main characteristics, quality, functionality or intended use of the product.

Nothing in this section limits your statutory right to receive goods that are as described, of satisfactory quality and fit for their intended purpose.

For electronic products, compatibility with third-party devices, networks, software, operating systems, regional standards or applications may depend on factors outside Almond Store's control. Where specific compatibility is an essential requirement for you, please review the product information carefully before ordering or contact us for assistance.


4. Prices and Payment

The price displayed at the time you place your order will apply to your purchase, subject to correction of obvious pricing errors before the order is accepted.

Prices and any applicable taxes or delivery charges will be displayed before you complete your purchase. Any mandatory additional charges will be disclosed before you place the order.

Available payment methods will be shown during checkout.

Payments may be processed by third-party payment service providers and may be subject to authorisation, fraud prevention and security checks.

We may place an order under review or decline it before acceptance where payment authorisation fails, there are reasonable indications of fraudulent activity, account or payment information is materially inconsistent, or additional verification is reasonably required.

We will not impose additional optional charges without obtaining the consent required by applicable law.


5. Dispatch and Delivery

We aim to process orders and provide dispatch or tracking information within 24 hours of purchase where reasonably possible.

Our usual estimated delivery period is approximately 5 to 12 business days after dispatch, unless a different delivery estimate is shown before purchase.

Delivery dates and times are estimates unless we have expressly agreed that a particular date is essential or binding.

Under applicable UK distance-selling rules, goods must generally be delivered without undue delay and no later than 30 days after the contract is entered into, unless a different delivery period has been agreed with you.

If delivery is materially delayed, your statutory rights will remain unaffected.

Customers are responsible for providing a complete and accurate delivery address. If you notice an error in your delivery information, please contact us as soon as possible at shops@almond.com.


6. Ownership and Risk

To the extent permitted by law, ownership of the goods will not pass to you until we have received payment in full for those goods.

However, the risk of loss or damage to the goods remains with Almond Store until the goods come into your physical possession or the physical possession of a person identified by you to receive them.

If you independently arrange for delivery using a carrier that was not offered by Almond Store, different rules regarding the transfer of risk may apply in accordance with applicable law.


7. Customer Responsibilities

You agree to provide accurate, complete and reasonably up-to-date information when placing an order.

You must not use the Almond Store website or services unlawfully, interfere with the security or technical operation of the website, attempt to obtain unauthorised access to systems or accounts, or infringe the rights of Almond Store or third parties.

You are responsible for using products in accordance with the instructions, warnings and safety information supplied with them.

Nothing in this section affects your rights where goods are faulty, unsafe, incorrectly supplied, not as described or otherwise fail to comply with applicable consumer law.


8. Prohibited and Fraudulent Activity

You must not engage in fraudulent or abusive activity in connection with Almond Store.

This includes, without limitation:

• unauthorised use of payment methods;
• fraudulent payment disputes or chargebacks;
• deliberate submission of false claims or evidence;
• product substitution or return fraud;
• deliberate damage followed by a false defect claim;
• manipulation or circumvention of technical or security systems;
• automated ordering intended to interfere with ordinary shop operations;
• fraudulent exploitation of promotions or discount systems; and
• any other conduct that is unlawful or deliberately intended to defraud Almond Store or another person.

Almond Store may investigate suspected fraudulent activity and may take reasonable measures to protect customers, payment providers and the business.

Nothing in this section prevents or discourages customers from exercising legitimate statutory rights, making genuine complaints, requesting lawful refunds or raising legitimate payment disputes.


9. Consumer Cancellation and Return Rights

Consumers purchasing goods online generally have a statutory right to change their mind and cancel their purchase within 14 days from the day after receiving the goods, subject to applicable legal exceptions.

If an order consists of multiple products delivered separately, the applicable cancellation period may begin after the final item is received.

After notifying us of your decision to cancel, goods must generally be returned within 14 days.

These cancellation rights are separate from your rights where goods are faulty, damaged, incorrectly supplied or not as described.


10. Faulty Goods and Statutory Consumer Rights

Products supplied by Almond Store must comply with the requirements of applicable UK consumer law.

Under the Consumer Rights Act 2015, goods supplied to consumers must, among other things, be:

• of satisfactory quality;
• fit for their intended purpose; and
• as described.

Where qualifying goods fail to conform to the contract, consumers may have statutory remedies including the short-term right to reject the goods, repair, replacement, price reduction or final rejection, depending on the circumstances and the time that has passed.

For many qualifying faults, consumers have a 30-day short-term right to reject the goods and request a refund.

After that period, repair or replacement may generally be available in the first instance where required by law. Further remedies may apply if repair or replacement is impossible, unsuccessful, cannot be completed within a reasonable time or causes significant inconvenience.

Any manufacturer's warranty, commercial guarantee or voluntary warranty offered in relation to a product is additional to, and does not replace or reduce, your statutory consumer rights.


11. Liability

Nothing in these Terms excludes or limits Almond Store's liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• goods that are faulty or not as described where liability cannot lawfully be excluded;
• breach of your statutory consumer rights; or
• any other liability that cannot legally be excluded or restricted.

If you are purchasing as a consumer, Almond Store is responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable if it was an obvious consequence of the breach or if both you and Almond Store knew that it might occur when the contract was entered into.

Almond Store is not responsible for losses caused solely by circumstances attributable to the customer's misuse of a product, failure to follow safety or operating instructions, unauthorised modification or other conduct for which Almond Store is not legally responsible.

Products sold for personal consumer use are not intended for commercial or business use unless expressly stated otherwise. Where you are acting as a consumer, we will not normally be responsible for business-related losses such as loss of profits, business interruption or loss of commercial opportunity.

Nothing in this section limits any mandatory consumer remedy.


12. Intellectual Property

Text, graphics, logos, photographs, product descriptions, website design elements and other content appearing on the Almond Store website may be protected by copyright, trade mark rights or other intellectual property rights belonging to Almond Store, its licensors, suppliers or other rights holders.

You may use the website for personal and lawful shopping purposes.

Content must not be reproduced, distributed, commercially exploited, modified or used in a manner that infringes intellectual property rights unless such use is permitted by law or appropriate permission has been obtained.


13. Privacy and Personal Data

Personal data is processed in accordance with the Almond Store Privacy Policy.

Our Privacy Policy explains how personal data may be collected, used, stored and shared in connection with orders, payments, deliveries, customer support, fraud prevention, website operation, analytics and marketing.

Nothing in these Terms reduces any rights available to individuals under applicable UK data protection law.


14. Governing Law and Jurisdiction

These Terms and contracts entered into through Almond Store are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.

If you are a consumer resident in Scotland, Northern Ireland or another jurisdiction whose mandatory consumer law applies to your purchase, you will continue to benefit from any mandatory protections provided by the law of your place of residence that cannot lawfully be excluded by agreement.

Nothing in these Terms is intended to prevent a consumer from bringing proceedings before a court that has jurisdiction under applicable consumer law.


15. Severability

If any provision of these Terms is found by a court or competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the minimum extent necessary.

The remaining provisions will continue in full force and effect to the extent permitted by law.
